- Definitions
- 1.1. “The Agency” refers to ICGS LLC doing business as EscapeXperts, a limited liability
company organized under the laws of the State of Delaware, United States. - 1.2. “The Client” refers to the individual or legal entity contracting the travel-related
services offered by The Agency. - 1.3. “Services” refers to the personalized travel planning, itineraries, coordination, and
reservation services provided or arranged by The Agency, including accommodations,
transportation, and experiences. - Our Services
- 2.1. The Agency, acting as a travel advisor and intermediary, agrees to coordinate the
Services as specified in the itinerary or agreement provided to the Client, subject to
availability and the terms and conditions of third-party providers. - Payments
- 3.1. A non-refundable planning or design fee is required to initiate any custom travel
project. The amount will be specified in writing before any work begins. - 3.2. Final payments must be made in accordance with the agreed payment schedule.
Failure to comply may result in cancellation of services, with no refund. - Intermediary Role
- 4.1. The Agency acts solely as an intermediary between the Client and third-party
service providers, including but not limited to airlines, hotels, transport operators, and
local vendors. - 4.2. The Agency is not liable for any acts, omissions, or breaches of contract by third-
party service providers. However, The Agency may assist the Client in requesting
changes or refunds where possible, subject to each provider’s terms. - Limitation of Liability
- 5.1. The Agency shall not be held liable for any personal injury, illness, property damage,
financial loss, or other damages incurred during or related to the Client’s trip. - 5.2. In cases of force majeure (including but not limited to natural disasters, pandemics,
political unrest, or unforeseen disruptions), The Agency is not responsible for
cancellations or interruptions. Any possible refunds are subject to third-party supplier
policies, with a 20% administrative fee retained by The Agency. - Client Responsibilities
- 6.1. The Client is solely responsible for obtaining and complying with all travel
requirements, including passports, visas, health documents, vaccinations, and
insurance. - 6.2. The Agency bears no responsibility for issues resulting from the Client’s failure to
meet legal or logistical requirements. - Cancellations and Changes
- 7.1. All cancellations must be submitted in writing. Refunds (if applicable) are governed
by the cancellation policies of the third-party providers. The Agency reserves the right
to retain up to 20% of total trip costs for administrative processing. - 7.2. Requested changes (such as dates, destinations, or activities) must be submitted at
least 40 days in advance and may incur additional fees, depending on supplier
flexibility. - Refunds
- 8.1. In the event of cancellation by a service provider, The Agency will make reasonable
efforts to assist the Client in obtaining a refund in accordance with that provider’s
terms. - 8.2. No refunds will be issued for cancellations or interruptions resulting from the
Client’s actions or omissions. - Travel Documentation
- 9.1. The Agency will deliver all travel documents (including confirmations, vouchers,
and tickets) via email unless otherwise agreed. - Acceptance of Terms
- 10.1. By confirming a booking, submitting payment, or accepting any travel-related
documentation from The Agency, the Client agrees to these Terms & Conditions in full. - Governing Law and Jurisdiction
- 11.1. These Terms shall be governed by and construed in accordance with the laws of
the State of Delaware, United States. - 11.2. Any dispute arising out of or relating to these Terms shall be subject to the
exclusive jurisdiction of the courts located in the State of Delaware. - Language
- 12.1. These Terms may be provided in English and Spanish. In case of any inconsistency
or conflict, the English version shall prevail. - Third-Party Services
- 13.1. In cases where services are coordinated through third parties or outside vendors,
The Agency disclaims any liability for performance, cancellations, or changes by those
third parties. - Contract Copy
- 14.1. A copy of these Terms & Conditions will be available to the Client at the time of
booking and/or published on the official website. - Termination and Penalty
- 15.1. Breach of these Terms by either party shall be grounds for termination. If the
breach is attributable to The Agency, any amounts paid for services not delivered will be
refunded. If attributable to the Client, refunds are subject to the limitations outlined
above.
